Terms and Conditions

  1. Introduction: This terms and condistions agreement is in between XD HOTELS and TRAVELs, including its staff and partners, (hereinafter referred to as ” THE PROPERTY OWNER “) And the Occupant(s) of short stay guests at managed flats at Building-165 and 187, 6th cross, RK TOWNSHIP, Bommasandra Bangalore, (hereinafter referred to as ” THE GUESTS “)
  2. Liability: THE PROPERTY OWNER shall not be held liable for any direct or indirect material loss or damage incurred by the occupant(s) during their stay at the Property.  THE GUESTS assume full responsibility for any such losses or damages.
  3. Power Assurance: Power assurance is subject to the services provided by Bangalore Electricity Supply Company (BESCOM).  THE PROPERTY OWNER   shall not be responsible for any disruptions in power supply beyond their control, and THE GUESTS acknowledge this limitation.
  4. Property Damage:  THE GUESTS agree that any damage caused to the Property during their stay shall incur charges based on actual repair or replacement costs, as assessed by THE PROPERTY OWNER .
  5. Parking Availability: Parking availability is provided on a first-come, first-serve basis, and THE PROPERTY OWNER   do not guarantee parking space availability at all times.
  6. Consent to Share Personal Details:  THE GUESTS consent to sharing their personal details with  THE PROPERTY OWNER  or relevant authorities as required by local law and business administration needs.
  7. Shared Internet Usage:  THE GUESTS accept liability for any legal consequences arising from shared internet usage at the Property and agree to use it responsibly.
  8. Checkout Policy:  THE GUESTS agree to checkout from the Property before 11:00 AM on the agreed date of departure to avoid any additional charges or liabilities.
  9. Noise and Party Policy:  THE GUESTS agree not to create excessive noise or host parties within the flat, respecting the tranquillity of the surrounding environment and the rights of neighbouring occupants. In the event that THE GUESTS breach this policy, XD HOTELS and TRAVELs,  THE PROPERTY OWNER , reserves the right to demand immediate vacation of the property without any refund or compensation to THE GUESTS. Should THE PROPERTY OWNER   deem the noise or party disturbance to be significant or disruptive to the peace and well-being of other occupants or the property itself, the Guest agrees to comply with the demand for immediate vacation of the property upon notification by  THE PROPERTY OWNER  . The Guest acknowledges that failure to comply with the demand for immediate vacation of the property under such circumstances may result in legal action being taken against them, and they agree to indemnify THE PROPERTY OWNER   against any losses, damages, or expenses incurred as a result of their non-compliance.
  10. Property Access for Cleaning:  THE GUESTS consent to allowing property access for cleaning and administrative purposes as deemed necessary by THE PROPERTY OWNER  .
  11. Legal Disputes: All legal disputes shall be resolved within the jurisdiction of Bangalore courts, and  THE GUESTS agree to abide by this jurisdiction.
  12. Key Return Policy:  THE GUESTS agree to return all keys to the Property on time to avoid any additional liabilities or charges.
  13. Consent to Remote Camera:  THE GUESTS consent to the presence of remote cameras in common areas of the Property for security purposes.
  14. Property Care:  THE GUESTS agree to take very good care of the Property to avoid incurring any additional liabilities or charges.
  15. Vacating Property:  THE GUESTS agree to vacate the Property immediately upon the owner’s demand, complying with any eviction notices issued.
  16. Property Inspection:  THE GUESTS agree to allow staff to review the Property during their stay and before checkout for inspection purposes.
  17. Business Proceedings:  THE GUESTS agree not to conduct any business proceedings or obtain loans using the Property address without prior written consent from THE PROPERTY OWNER .
  18. No Refund Policy:  THE GUESTS acknowledge and agree that no refunds shall be issued under any circumstances, including but not limited to early termination of his stay, as per THE PROPERTY OWNER assessment.
  19. Liability for Noise or Nuisance:  THE GUESTS accept full liability for any noise or nuisance caused to neighbours or the property owner due to their actions or conduct during their stay at the Property.  THE GUESTS agree not to create excessive noise or host parties within the flat, respecting the tranquillity of the surrounding environment and the rights of neighbouring occupants. In the event that  THE GUESTS breach this policy, XD HOTELS and TRAVELs,  THE PROPERTY OWNER , reserves the right to demand immediate vacation of the property without any refund or compensation to  THE GUESTS. Should  THE PROPERTY OWNER   deem the discipline, noise or party disturbance to be significant or disruptive to the peace and well-being of other occupants or the property itself,  THE GUESTS agrees to comply with the demand for immediate vacation of the property upon notification by  THE PROPERTY OWNER  .  THE GUESTS acknowledges that failure to comply with the demand for immediate vacation of the property under such circumstances may result in legal action being taken against them with financial penalties, and they agree to indemnify  THE PROPERTY OWNER   against any direct or indirect losses, damages, or expenses incurred as a result of their non-compliance.
  20. Additional Charges for Delayed Checkouts:  THE GUESTS agree to pay an additional amount for delayed checkouts beyond the agreed-upon checkout time, as per THE PROPERTY OWNER assessment. Any delay in checkout time will lead to full upcoming month rental charges as penalty, to be paid by THE GUESTS.
  21. Informed Checkout to Avoid Liabilities:  THE GUESTS agree to inform  THE PROPERTY OWNER   in advance of their intention to checkout, ensuring a smooth transition and avoiding any additional liabilities or charges. The Guests understand to take outside any luggage or belongings left behind in property. The PROPERTY OWNER will not own any liability of property loss during their stay or post checkout.
  22. Sharing of KYC Documents:  THE GUESTS consent to the sharing of their KYC documents with  THE PROPERTY OWNER   and their authorized company staff for legal and regulatory purposes as applicable under Indian laws.
  23. Legal Authority of Signee: The signee hereby declares that they have the legal authority to sign this agreement on behalf of all co-guests who will stay with them in the flat. The signee assumes full liability and responsibility for ensuring that all co-guests are made aware of and agree to abide by the terms and conditions outlined in this agreement.
  24. Liabilities of THE GUESTS:  THE GUESTS acknowledge and agree to own all liabilities as per the clauses listed in this agreement.  THE GUESTS assume full responsibility for complying with the terms and conditions outlined herein and agree to indemnify  THE PROPERTY OWNER   against any direct or indirect damages, losses, or expenses incurred due to  THE GUESTS’s actions or conduct during their stay at the flat.  THE GUESTS agrees to be responsible for any legal expenses incurred by THE PROPERTY OWNER , directly or indirectly, full or partly related to their stay at the given property. This includes but is not limited to, costs associated with legal proceedings, court fees, attorney fees, and any other legal expenses deemed necessary by  THE PROPERTY OWNER  . In the event that legal action is initiated against THE PROPERTY OWNER, or any legal proceedings are undertaken due to actions or conduct of  THE GUESTS during their stay at the property,  THE GUESTS agrees to bear the actual costs of such legal proceedings. THE GUESTS acknowledges that they shall be charged based on actual incurred expenses and not on an estimated or predetermined basis. Any legal fees or expenses shall be communicated to  THE GUESTS by  THE PROPERTY OWNER  , and  THE GUESTS agrees to settle such charges promptly upon receipt of notification. By entering into this agreement,  THE GUESTS acknowledges and agrees to indemnify  THE PROPERTY OWNER   against any legal expenses or liabilities arising from their actions or conduct during their stay at the property, and further agrees to reimburse  THE PROPERTY OWNER   for any such expenses incurred. THE GUESTS agrees to own liability related to any reputation loss, any direct or indirect business loss, in current date or future, happened due to actions of THE GUESTS . THE GUESTS further agrees that such charges will be settled within three working days from the date of notification by THE PROPERTY OWNER  . Failure to settle these charges within the specified time will result in monthly compounding costs being applied until the outstanding amount is cleared.
  25. Dispute Resolution with Banks or Credit Card Payments:  THE GUESTS agree not to dispute any charges made by  THE PROPERTY OWNER   through banks or credit card payments, understanding that such disputes may result in legal action.  In the event of any dispute arising between  THE GUESTS and  THE PROPERTY OWNER, Guest agrees to reimburse  THE PROPERTY OWNER   for both direct and indirect business costs incurred as a result of the dispute. These costs may include but are not limited to legal fees, administrative expenses, and any other costs directly related to resolving the dispute. By entering into this agreement,  THE GUESTS acknowledges and agrees to bear the responsibility for reimbursing  THE PROPERTY OWNER   for any costs incurred due to disputes arising during their stay at the property.
